Consumer protection in online shopping and law changed

1. A company selling online products including Bollywood actors Govinda and Jackie Shroff has been fined in Muzaffarnagar, Uttar Pradesh.  Advocate Brij Bhushan Aggarwal had done an online shopping for an oil related to joint pain in the year 2013-14.  Govinda and Jackie claimed 100 per cent profit through advertising.  There was also talk of money back guarantee in 15 days if there is no profit.  According to Abhinav Agarwal, son of complainant Brij Bhushan Agarwal, he did not benefit from the drug and after talking to the authorities he sent the oil back to the company from the courier within 13 days.  There was no communication from the company regarding the refund of the money.  After this, Brij Bhushan Agarwal in the consumer forum, oil producer company, seller online company, local distributor and advertisement Filing suit was filed against Govinda and Jackie Shroff.  On November 15, the Consumer Forum imposed a fine of Rs 26,710 on the accused.

2. A resident of Mandi of Sadalla, an online shopping site, booked a mobile / camcord for himself for Rs 3, 398.  Within a few days, many kinds of problems started coming up in Phan.  Contact with the agent.  There was a demand to return the money.  The company refused to do so.  The affected person filed a lawsuit in the Consumer Forum and demanded money.  The forum responded to the company.  did .  The company argued that it is only a medium between buyer and seller.  It has nothing to do with the quality of the product.  This argument was considered inadequate by the forum and the company was fined 10 thousand rupees in lieu of 3 / thousand phone calls.  The forum directed the price of the phone to be paid including 10 / percent interest (on the day of complaint. From 2015 till now).  The forum commented - Companies cannot escape responsibility.  Earning customer confidence should be more important.  Both cases show that if a company or organization sells products through misleading advertisements, then we can take strict action against it.  However, for that we have to be aware of the rights as a consumer.  Most people wonder why go to the forum for a small amount, while doing so we protect the rest of the consumers from fraud and make them aware.

E-payment through mobile or website, or the purchase of goods from the mobile app has changed the relationship between the customer and the shopkeeper in India to a great extent.  In such a situation, the Consumer Protection Convention, made in 1986, has been changed to protect the rights of customers.  Of the old law under the Consumer Protection Act, 2019 Shortcomings have been overcome.  This included the formation of a central regulator, imposing heavy penalties on misleading advertisements, and e-commerce firms and.  Strict guidelines have been issued regarding companies selling electronic devices.


  • Complaint can be lodged anywhere



Consumer courts (consumer redressal commissions) have been set up at district, state and national levels to deal with consumer complaints.  The new law extends their jurisdiction.  Now the district courts will be able to hear cases up to one crore rupees.  With this, consumers can register complaints from anywhere.  (Previously, the consumer could file a complaint only where the seller offers services.) This is a right step given the growing buying trend from e-commerce.  In addition, the law allows the consumer to attend the hearing through video conferencing.

This will motivate consumers to exercise their rights by saving money and time.  Accountability of the manufacturing company has been fixed that the company will have to pay compensation if there is a loss to the consumer due to defects in manufacturing or poor services.  For example, if the pressure cooker bursts due to a manufacturing failure and injures the consumer, the company will have to pay damages for the accident.  Earlier, the consumer used to get only the cost of the cooker.  For this too, he had to knock the door of the civil court.

  • National Consumer Day on 24 December


Consumers of any kind.  To protect against fraud and exploitation.  The Consumer Protection Act - 1986 was enacted on 24 December 1986.  National Consumer Day is celebrated on this day.  Amendments were made to the Act in 1991 and 1993.  Extensive amendments took place in December 2002 and were implemented from 15 March 2003.  The Consumer Protection Rules, 1987 was also amended and notified on 5 March 2004.  This day was first celebrated in the year 2000.


  • International Consumer Protection Day



International Consumer Protection Day is observed on 15 March.  The consumer movement was started in the US by Ralp Nader.  On March 15, 1962, the Consumer Protection Bill was approved by then President John F. Kennedy in the US Congress.  For this reason, International Consumer Day is observed on 15 March.

At any stage, if you feel cheated you can complain like this:

  1. A consumer can write a complaint on a plain paper and give it in the forum.
  2. The complaint should have complete details of the case, such as when and where the incident happened!  Along with the complaint, the consumer has to present the bill of goods and other documents.
  3. In the forum, litigants with claims up to Rs 1 lakh can be presented for a fee of just Rs 100.
  4. A complaint can be lodged by going to Consumer Affairs Helpline 1800 - 11 -4000 or 14404 and website consumerhelpline.gov.in
  5. Complaints are also possible by SMS to another number 8130009809 of the forum.  The medium
  6. Complaints can be made through the National Consumer Helpline (NCH App) and Umang App.
  7. If the loss to the consumer is less than Rs 20 lakh, then the complaint is possible in the District Forum.
  8. If there is a loss of more than 20 lakhs and less than 1 crore rupees, file a complaint with the State Commission.  - In case of more than Rs 1 crore, a complaint has to be filed with the National Commission.
  9. Just as the case is heard in the High Court after the case is dismissed in the lower court, similarly the case from the lower forum.  After being rejected, a complaint can be made in the forum above.
